Dfence Terms of Use

Welcome to Dfence! These Terms of Use ("Terms") govern your access to and use of the services provided by Dfence and its affiliates ("Dfence," "we," "our," or "us"), including our websites, dashboard, edge platform, APIs, SDKs, and related services (collectively, the "Services").

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Eligibility and Acceptance

By using the Services, you represent that:

  • You are at least 18 years old.
  • You have the authority to bind the legal entity (the "Customer") you represent.
  • You agree, on behalf of the Customer, to these Terms and our Privacy Policy.

If you do not agree to these Terms, you must refrain from accessing or using the Services. Continued access or use constitutes binding acceptance of these Terms by you or the entity you represent.

Note:

By using Dfence's Services, you confirm that you have reviewed and accepted the terms of our Data Processing Addendum (DPA), which governs Dfence's processing of personal data on your behalf.

2. Services Overview

Dfence is a real-time account-sharing detection and prevention platform designed for SaaS publishers. It helps companies protect their revenue, ensure fair usage, and convert unauthorized account sharers into paying customers. Dfence provides a comprehensive solution for SaaS companies to prevent account sharing, protect their revenue, and ensure fair usage.

Plan

Currently, Dfence offers a single enterprise plan designed to meet the needs of organizations requiring robust, large-scale, and mission-critical solutions.

Service fees and any applicable charges are determined based on a custom agreement with each Customer. For more information or to request a quote, please contact the Dfence team directly.

Unless otherwise agreed in writing, all agreements commence on the date the Customer is onboarded and continue according to the terms specified in the executed contract. Payment terms are as defined in the agreement.

Dfence reserves the right to enforce usage limits, restrict access to features, or adjust service levels in accordance with the terms of the applicable enterprise agreement.

Service Levels

Dfence uses commercially reasonable efforts to ensure platform availability and performance for all users. Enhanced service level agreements (SLAs), including uptime guarantees and premium support, are available only to customers on the Enterprise plan and may be defined separately in an applicable service order or agreement.

3. Customer Responsibilities

You, as the Customer, are responsible for:

  • Ensuring your configuration and use of Dfence complies with applicable laws, including privacy and data protection regulations.
  • Managing access to your account and maintaining confidentiality of API keys and login credentials.
  • Ensuring your end users are informed and that valid consent is obtained when required by law.
  • Accurately setting privacy and consent preferences in the Dfence dashboard.

4. Account and Access

You must register for an Dfence account to access the Services. You agree to:

  • Provide accurate, complete, and current information.
  • Notify Dfence immediately of any unauthorized use of your account.
  • Use the Services only for lawful and authorized purposes.

5. Acceptable Use

You agree not to:

  • Use the Services to transmit unlawful, abusive, or harmful content.
  • Attempt to disrupt or degrade Dfence's infrastructure.
  • Reverse engineer or decompile any part of the platform.
  • Circumvent any usage limits or access controls.

Dfence reserves the right to suspend or terminate access if you violate these Terms.

6. Data Processing and Privacy

Dfence acts as a data processor when processing end user data on your behalf. Our processing is governed by the Dfence DPA, which is hereby incorporated into these Terms by reference.

We encourage you to read our Privacy Policy to understand how Dfence collects and processes personal data for its own operational purposes.

7. Intellectual Property

Dfence retains all rights, title, and interest in the Services, including all software, trademarks, and documentation.

You retain ownership of any content or configuration you submit through the platform.

8. Modifications to the Terms

We may update these Terms from time to time. Material changes will be communicated via the dashboard or email. You will be asked to accept the updated Terms upon your next login. Continued use of the Services after an update constitutes acceptance.

9. Suspension and Termination

Dfence may suspend or terminate your access to the Services for:

  • Violation of these Terms
  • Legal or regulatory reasons
  • Inactivity or account misuse

You may terminate your account at any time via the dashboard. Termination does not relieve you of any payment obligations or restrict Dfence's right to enforce these Terms.

10. Disclaimers and Limitation of Liability

The Services are provided "as is" without warranty of any kind. To the maximum extent permitted by law:

  • Dfence disclaims all warranties, express or implied.
  • Dfence is not liable for any indirect, incidental, or consequential damages.
  • Dfence's total liability under these Terms shall not exceed the amount paid by the Customer in the 12 months preceding the claim.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of France, unless otherwise specified in a Master Service Agreement. Any disputes shall be resolved in the courts of Paris, France.
